Defamation

Also called: libel, slander

A video counts as the published form, so commentary channels are exposed to libel even though the words are spoken aloud. The usual defences are that the statement is true, that it is honest opinion clearly framed as opinion, or that publication served the public interest. In England and Wales a claimant also has to show serious harm to reputation, while in the United States a public figure has to prove the statement was made knowing it was false or with reckless disregard for whether it was. The practical protections are dull and they work: say allegedly and mean it, separate what you can evidence from what you suspect, keep your sources, and phrase judgements as your own view. This is a summary and it is not legal advice.
