Fair dealing

Also called: fair dealing exception

Where American law asks whether a use is fair on balance, these systems ask first which purpose you are claiming. The UK permits criticism, review and quotation, reporting current events, non-commercial research and private study, and caricature, parody or pastiche. Canada's list adds education and satire. Australia covers research or study, criticism or review, parody or satire, and news reporting.

Land outside the list and the argument stops there, however reasonable your use looks. Several of those purposes require you to credit the source properly. None of it registers with Content ID, which matches audio and picture automatically and leaves you to raise the exception yourself in a dispute.
